The Chairman made the following statement: “We appear to be in the extremely disappointing position that confidential papers relating to today’s meeting have been disclosed to media outlets in advance of today’s meeting, which undermines individuals’ privacy and the integrity of the informal resolution process. Nevertheless, these actions do not strip the information in our agenda pack of its exempt character for access-to meetings-purposes.” |

Exclusion of Press and Public. The public are likely to be excluded during the following item of business in accordance with Section 100(A) of the Local Government Act 1972:- · Complaints
against the Police and Crime Commissioner. Minutes: RESOLVED: That under Section 100A of the Local Government Act 1972, the public be excluded for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in the paragraphs of Part 1 of Schedule 12A of the Local Government Act 1972 and, in all circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information: · Complaints against the Police and Crime Commissioner. |

Complaints against the Police and Crime Commissioner. Minutes: The Subcommittee considered an exempt report of the Director
of Law and Governance at Leicestershire County Council which outlined the detail of two complaints made about
the Police and Crime Commissioner. A copy of the report, marked ‘Agenda Item
3’, is filed with these minutes. The Report was not for publication virtue of
paragraphs 1 and 10 of Schedule 12(A) of the Local Government Act 1972. The Director of Law and Governance outlined that the Subcommittee’s role was to facilitate an informal resolution to complaints but was not a disciplinary process and did not involve any sanctions. In the consideration of complaints, Police and Crime Panels had to comply with regulations laid down by the Government under the Police Reform and Responsibility Acts 2011 and Elected Local Policing Bodies (Complaints and Misconduct Regulation 2012, Reg 28 (11), (12) and (13). The Subcommittee
asked the PCC a series of questions in relation to the complaints outlined
within the report. The Chairman thanked
the PCC for his attendance and informed him that it would be necessary for the
Subcommittee to deliberate the most suitable course of action in order to
assist informal resolution of the complaints, in private. The PCC was informed
that a record of outcome would be shared with him, following the meeting. (At this point,
the PCC left the meeting). The Subcommittee
deliberated the most suitable course of action in order to assist informal
resolution to the two complaints. RESOLVED: That the conclusions
reached by the Panel’s Complaints Subcommittee regarding its consideration of
complaints submitted against the Police and Crime Commissioner for Leicester,
Leicestershire & Rutland (“the PCC”), be shared with the PCC and the complainants
following the meeting. |
