The minutes of the meeting held on 22 June 2023 were taken as read, confirmed and signed.

The Chairman invited members who wished to do so to declare any interests in respect of items on the agenda for the meeting.

 

It was noted that all members who were members of a Parish, Town or District Council, or Liaison Committee would have personal interests in applications which related to areas covered by those authorities.  No further declarations were made.

The Board considered a report of the Director of Environment and Transport, a copy of which, marked ‘Agenda Item 7’, is filed with these minutes.

 

In accordance with the procedure for making representations to the Board, Mr. T. Chaplin (for Ratcliffe on the Wreake Parish Council) and Mr. J. Poland CC (the local member) spoke against the application and Mr. H. Shaw spoke on behalf of the applicant.   

 

The Director of Environment and Transport advised the Board regarding guidance which had been published by the Government on 1 August 2023 concerning the diversion or extinguishment of public rights of way.  

 

RESOLVED:

 

That an Order be made under Section 119 of the Highways Act 1980 to divert Public Footpath I63a at Ratcliffe on the Wreake as shown on the Plan no. 2585/R1 appended to the report.

 

REASONS FOR DECISION:

 

The application to divert Footpath I63a satisfies the relevant statutory criteria set out under the provisions of S119 of the Highways Act 1980. It is expedient in the interests of the owner to divert the path, the effect of the Order does not alter either point of termination of the path, and the alternative route is not substantially less convenient and would not have a significant negative effect on the public enjoyment of the path as a whole.
