The minutes of the meeting held on 13 February 2025 were taken as read, confirmed and signed.

Mr. L. Phillimore CC declared a registerable interest in agenda item 9: New Lubbesthorpe Primary School as he was a member of Blaby District Council.

The Board considered a report of the Director of Environment and Transport, a copy of which, marked ‘Agenda Item 7’, is filed with these minutes. The Board was also in receipt of a supplementary report which responded to representations submitted on behalf of the landowners.

 

In accordance with the procedures for making representations to the Board, Nikki Beers (Faxtons) spoke on behalf of the landowners in objection to the application, and Cllr Margaret Smidowicz (Charnwood Borough Council) and Andy Travis (local resident) spoke in favour of the application.

 

In response to a question from a member, the Director of Environment and Transport confirmed that were the Board to permit the application, the next stage of the process would be for a public consultation to take place and were any objections to be made during that process the matter would be referred to the Planning Inspectorate and a Public Inquiry could take place.

 

RESOLVED:

 

That an Order be made under the provisions of Section 53 of the Wildlife and Countryside Act 1981 to add Public Footpath K110 at Nanpantan, Loughborough to the Definitive Map as shown on Plan No. M1269.

The Board considered a report of the Chief Executive, a copy of which, marked 'Agenda Item 8', is filed with these minutes.

 

The Chief Executive reported that the local member Mr. T.J. Pendleton CC had raised concerns that should the quarry be filled with Pulverised Fuel Ash (PFA) it could have an impact on the net water volume level. In response the Chief Executive confirmed that there were no intentions for PFA to be used in the quarry.

 

In response to queries raised by members about potential damage to the Scheduled Monuments within or nearby the site caused by the extraction and restoration work at the site, the Chief Executive drew attention to proposed condition no. 49 which required a detailed Water Action Management Plan to be produced and an Annual Report to enable the Mineral Planning Authority, Natural England and Historic England to monitor the effects of the development on the Scheduled Monument. It was also explained that should there be damage to the Scheduled Monuments arising from the development the Mineral Planning Authority could serve an Enforcement Notice for breach of conditions requiring the applicant to remedy the situation. Though the exact remedy would depend on the nature of the damage caused.

 

RESOLVED:

 

That the application be permitted subject to the conditions nos. 1-77 set out in Appendix A and the prior completion of a S106 legal agreement requiring the formation of a liaison committee and securing provision for a permissive bridleway.

RESOLVED:

 

That the application to vary the obligations so that the obligations as set out in the Sixth schedule to the S106 agreement as set out in Appendix A be substituted by the wording of the Sixth schedule shown in Appendix B, be permitted.

The Chairman announced that the next meeting of the Board would take place on Thursday 12 June 2025 at 2.00pm.
